Governing Law and Dispute Resolution

OXYGEN is controlled, operated and administered entirely within the State of Texas USA. The laws of the State of Texas shall govern this Agreement for all matters, including dispute resolution.

If a dispute arises under this Policy we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Dallas County, Texas USA. We agree that this mediation will be kept confidential. Mediation fees and costs shall be split equally, and we are each solely responsible for our respective lawyer fees.

If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to confidential binding arbitration at the following location: Dallas County, Texas USA. Arbitration shall be held under the commercial rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.
